Personal Injury Law

Personal Injury Law

The Diaz Firm, PLLC, will hold your hand all the way through your personal injury law experience. Personal injury (PI) law covers situations in which a person’s body, mind or emotions are hurt, usually due to someone else’s negligence or carelessness. It includes wrongful death: situations where an injury proves fatal. We will work closely with you and your family to determine the best outcome for you in your case. We have over 33 years of experience litigating PI cases before judges and juries throughout the state. We know what it takes to win for you. Usually, a personal injury case begins when the injured person, known as the plaintiff, sues a person or business, known as the defendant. A personal injury lawsuit claims that the defendant caused the plaintiff’s injury and demands compensation, usually in the form of a money payment known as damages. Although personal injury law covers any kind of case where a person is injured, some kinds of personal injury cases are more common than others. Common personal injury cases include:

  • Car accidents, including accidents with large trucks, motorcycles or pedestrians
  • Consumer product liability cases, including defective products, medications and recalled products
  • Injuries caused by animals, like dog bites
  • Injuries from ultra-hazardous activities, like the use of explosives or chemicals
  • Slip-and-fall injuries and other premises liability cases
  • Injuries to reputation caused by defamation
  • Injuries to mental and emotional health caused by intentional infliction of emotional distress or caused by a physical injury

State and Federal Criminal Defense

We Defend Criminal Charges For U.S. Citizens And Immigrants

Being accused of a crime is troublesome for both United States citizens and immigrants. If convicted of a crime, you may face substantial penalties and life-altering consequences. If you are an immigrant to the U.S., you may encounter the additional immigration consequences such as the risk of deportation and removal, or an ICE hold.

Even as a legal resident with a green card or visa, if you are charged with a crime, you may suffer aggressive prosecution, harsh sentencing and eventual deportation. If you have been arrested or the police are investigating you reg

arding a crime, it is crucial that you protect your rights.

Serious Penalties For Criminal Convictions

If you are a U.S. citizen that is convicted of a crime, you may be sentenced to years in prison and face steep fines. If you are a foreign national, you may face more severe immigration consequences.

Immigrants may be forced to pay fines and spend time in an Immigration and Customs Enforcement (ICE) detention center, awaiting removal from the country. Usually, one is barred from returning to the U.S. after a conviction involving crimes of moral turpitude or aggravated felonies, even if the crime was not considered an aggravated felony at the time of conviction.

We Defend Against Deportation

Expunction

Clear your record

In the common law legal system, an expungement proceeding is a type of lawsuit in which a person seeks to have the records of a criminal process sealed, making the records unavailable through the state or federal repositories. If successful, the records are said to be expunged and cannot be seen under most circumstances.  If you are not eligible for an Expungement of your arrest, you may be eligible to file a petition for Non Disclosure and keep your records from being seen by most employers and people.
